What is Estate Planning?

Estate planning involves a review of the client's assets and wishes to generate the structure, which is designed to pass those assets to the client's chosen beneficiaries. Estate planning usually includes a Last Will and Testament,  powers of attorney, and a Living Will. Trusts can also be developed to complement and support the Last Will. For high-net-worth individuals, estate planning in light of current estate tax laws is appropriate.

Probate

What is Probate?

Probate is the process of administering a deceased person's estate and implementing the transfer of a person's assets to their beneficiaries. Probate is a Court-driven process and involves drafting and filing legal documents with the Court. 

Who do we represent?

We represent all persons involved in any probate process in Middle Tennessee. This includes representing estates, proposed executors, administrators, creditors, and beneficiaries. If you receive any paperwork regarding a probate estate, it would be a good idea to check with an attorney to ensure your rights are protected.

What is the first step?

If you are involved in any probate proceeding or seeking legal information, please call our office to discuss with our staff whether we would be a good fit to represent you.  There are no fees for making an initial call.  

Conservatorship

What is a Conservatorship?

Conservatorship is a legal proceeding in which a court is asked to place the rights of a person who suffers from a disability in the hands of a trusted person called a Conservator.  In some states, a Conservatorship is called a Guardianship, but in Tennessee, the term Guardian only applies to minors.  Think of a Conservatorship as an incredibly strong version of a power of attorney.  

Conservatorships are only implemented in Tennessee upon a showing of clear and convincing medical evidence that someone suffers from a disability and requires the protection of the Court.

Who do we represent?

We represent all persons involved in Conservatorships from start to finish.  If you are considering asking the Court to establish a Conservatorship, we can help you and provide strong representation in this area of law.  If you are a family member of someone struggling with issues such as dementia or decreased capacities, we can review the case and make a recommendation about whether to begin the legal process.

Elder Law

What is Elder Law?

Elder Law involves planning for persons as they age.  In addition to developing an estate plan, we help families deal with early-onset dementia or other versions of a loved one's decreased capacity.  In some cases, a special needs trust, supplemental trust, or a Medicaid asset protection trust can be established to ensure access to long-term benefits.  We also provide knowledge of area caregivers and long-term care facilities, as well as represent families dealing with these facilities.

Calling our office with questions about how we can help is usually the right way to begin. With this area of work, the earlier you make a call, the more options are available to assist families.

Who do we help?

We help families with aging loved ones who are interested in developing a plan of care in light of the available family resources and the long-term care facilities in the Middle Tennessee area.
