Trusts

Hill Law drafts several sophisticated trusts for clients. Like any legal instrument, the value of a trust depends on how well it fits into the estate plan of the client, and can be a very effective tool.

Most people have heard about a living trust, or a revocable living trust, as a way to avoid probate.  If used correctly, it is true that the probate process can be avoided.  What most people have not learned, however, is that the probate process in Tennessee is relatively quick, inexpensive, and effective, so it may not be worth the trouble of avoiding it.  It also costs a lot more time and effort to generate a trust in comparison to a Last Will.  In addition to revocable living trusts, we also offer special needs trusts, QTIP trusts, asset protection trusts, marital trusts, and other common trust instruments.

We also represent trust beneficiaries and trustees in trust litigation, which usually occurs in probate Court.

Let us help you understand the differences between these options and guide you toward the right choice for your needs.  Call us at 615-345-0280 to schedule your appointment.
